Please review the following terms and conditions for using MotoRegistry.com website and services. Your use of MotoRegistry services constitutes an agreement to these terms and you represent that you have the authority to register according to these terms.

All content included throughout MotoRegistry services, such as text, graphics, logos, button icons, images, audio/video clips and software, is the property of MotoRegistry or its content suppliers and protected by Canadian/U.S. and international copyright laws. All software provided by the MotoRegistry services is the property of MotoRegistry or its software suppliers and is protected by Canadian/U.S. and international copyright laws.

User Accounts

In consideration of privilege to use MotoRegistry services, you agree:

  1. Not to share your account with anyone and never reveal your password to anyone including MotoRegistry staff.
  2. Not to use MotoRegistry services to send or post any message or material that is unlawful, harassing, libelous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, or encourage the use of controlled substances.
  3. Not to impersonate any other person or entity, whether actual or fictitious, including Impersonating an employee or consultant of MotoRegistry.
  4. Not to use an inappropriate sign-in name of any kind.
  5. Not to post or use MotoRegistry services to distribute or send any illegal material of any kind, including but not limited to, illegal material in the form of text, graphics, video, programs or audio.
  6. Misuse or abuse the service in regards to but not limited to exploiting bugs that may harm an individual, MotoRegistry, or provide wrongful benefit to anyone.
  7. Such actions shall constitute a material breach of these terms and conditions. MotoRegistry reserves the right to delete any content, postings or sign-in names that violate the above terms and will cooperate fully with any law enforcement officials and/or agencies in the investigation of any violation. Your account may be placed under a time-based or permanent ban.

Refunds & Cancellations

We are a reseller who facilitates convenient online registration and payment. Individual event organizers and venues offer their own separate refund policy. The refund policy for each event organizer and venue is explicitly shown before payment can be made. Charges will appear on your credit card or bank statement as "MotoRegistry.com" or "PayPal" on behalf of the event promoter or club.

In the rare case that an event is canceled by a hosting venue, the event will be rescheduled by the host and will be managed directly by the event organizer. The host may, at their sole discretion, refund your registration fees or credit you for an alternative future event.

Clubs / Event Promoters / Venues

MotoRegistry provides merchant services on behalf of clubs, event promoters and venues. By using MotoRegistry services you agree to the following service usage conditions:

  1. Waive MotoRegistry of all liability regarding transactions processed on your behalf.
  2. Understand that MotoRegistry service fees will automatically be deducted from each transaction and are non-refundable. Information on MotoRegistry service fees can be requested at anytime or viewed on our publically accessible website.
  3. MotoRegistry, on your behalf, may collect your registration fees no longer than 21 days (3 weeks) in advance of your scheduled event.
  4. MotoRegistry will hold 10% of all transactions that relate to future deliverable services (event registration) for the sole purpose of providing quick turn around in regards but not limited to chargeback requests and refunds on your behalf. Remaining held funds will be released on arrival of your event.
    1. In situations of chargebacks, MotoRegistry will place a hold funds equal to the transaction in question. During this time it is up to the club, event promoter or venue and the cardholder to come to an agreement, facilitated by MotoRegistry and information provided by credit card services. If an agreement cannot be determined in a timely manner, the funds will be released back to the card holder automatically and a fee of $25.00 will be charged to the club, event promoter or venue for failing to service the chargeback.

Indemnity

You agree to defend, indemnify and hold harmless MotoRegistry and its officers and employees from any claim, demand, loss, liability or expense (including reasonable legal fees), relating to or arising out of your use of MotoRegistry, any of its websites, any products purchased off of MotoRegistry services, your violation of these terms and conditions, or the infringement by you of any intellectual property or other right of any person or entity.

Term

You are not required to use the MotoRegistry service at any time. MotoRegistry reserves the right to terminate your account immediately and without notice upon any breach by you of these Terms and Conditions or upon your demonstration of conduct that MotoRegistry determines to be inappropriate.

Assignment

MotoRegistry may assign its rights and obligations under these terms and conditions and upon such assignment MotoRegistry may be relieved of any further obligation hereunder.

Ownership and Disclosure of Information

You own all of your business's private data, content and all information which you enter and use in connection with MotoRegistry services. We do not claim any rights, proprietary or otherwise over any data or information which you may use or disclose in connection with the MotoRegistry service. Notwithstanding the above, there may be circumstances in which we may be required to disclose data, such as the following:

  1. For the purposes of fraud prevention and law enforcement;
  2. To comply with any legal, governmental or regulatory requirement;
  3. To our lawyers in connection with any legal proceedings; and
  4. To comply with a court order.
If we are required to disclose your data or information, we will use our best efforts to provide you with reasonable notice in the circumstances and if appropriate the right to challenge any such request. MotoRegistry’s Privacy Policy sets out in greater detail how we strive to protect your privacy and limit disclosure of your personal information.

Limitation of Liability

THE SUBSCRIBERS AND THE USERS HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE THE MOTOREGISTRY PARTIES FROM ANY AND ALL MANNER OF RIGHTS, LOSSES, COSTS, CLAIMS, COMPLAINTS, DEMANDS, DEBTS, DAMAGES, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, NOR FOR ANY LOST PROFIT, ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES (COLLECTIVELY, A "CLAIM") WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH (I) THIS AGREEMENT; (II) THE USE OF MOTOREGISTRY AND ITS SERVICES AND ANY RELATED APPLICATIONS AND THIRD PARTY SERVICES; (III) THE USE OF ANY SOFTWARE RELATED TO MOTOREGISTRY; (IV) VIRUSES, SPYWARE, SERVICE PROVIDER FAILURES OR INTERNET ACCESS INTERRUPTIONS; (V) LOSS OF USE, LOSS OF DATA, ERROR, INACCURACY OF DATA, PAYMENT FAILURE, PAYMENT DEFECT, INACCURATE CALCULATIONS (EXCEPT AS OTHERWISE SET OUT HEREIN), DOWNTIME, IDENTITY THEFT, FRAUD OR UNAUTHORIZED ACCESS; OR (VI) ANY INFORMATION, DOCUMENT, MATERIALS, TOOLS, UTILITIES, PRODUCT OR DATA THAT RELATING TO THE USE OF MOTOREGISTRY AND THE SERVICES; WHETHER SUCH CLAIM IS BASED IN CONTRACT OR TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIM, OR SUCH CLAIM WAS REASONABLY FORESEEABLE AND NOTWITHSTANDING THE SUFFICIENCY OR INSUFFICIENCY OF ANY REMEDY PROVIDED FOR HEREIN OR IN ANY LICENSE.

FOR GREATER CERTAINTY, IN NO EVENT SHALL WE (AND OUR SUPPLIERS) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY LOST PROFIT OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THIS AGREEMENT OR YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ACCESS TO, AND USE OF, MOTOREGISTRY AND SERVICES ARE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE, MISUSE, ERROR, OR LOSS OF DATA ARISING FROM SUCH ACCESS AND USE.

EXCEPT IN THE MANNER PROVIDED FOR IN THESE TERMS OF USE, MOTOREGISTRY, ITS LICENSEES, AFFILIATES, AND THIRD PARTY SERVICE PROVIDERS, DISCLAIM, AND EXPRESSLY DO NOT PROVIDE ANY DIRECT OR INDIRECT, EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY AS TO TITLE, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY, OR MERCHANTABILITY; OR THAT MOTOREGISTRY, THE SERVICES, ANY THIRD PARTY SERVICES AND ONLINE SERVICES, AND ANY CONTENT, MATERIALS, TOOLS, UTILITIES, SOFTWARE AND FUNCTIONALITY WILL: (I) BE FIT OR SUITABLE FOR ANY SPECIFIC PURPOSE OR INTENDED USE; (II) MEET THE USERS' REQUIREMENTS AND EXPECTATIONS; (III) BE UNINTERRUPTED, FLAWLESS, TIMELY, ACCURATE, RELIABLE, SECURE OR ERROR FREE, OR; (IV) BE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT MOTOREGISTRY AND THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS AND YOU AGREE TO USE MOTOREGISTRY, THE SERVICES, ANY THIRD PARTY SERVICES AND ONLINE SERVICES, AND ANY CONTENT, MATERIALS, TOOLS, UTILITIES, SOFTWARE AND FUNCTIONALITY RELATED TO MOTOREGISTRY AT YOUR OWN RISK. YOU AGREE TO DETERMINE THE SUITABILITY OF MOTOREGISTRY AND SERVICES FOR YOUR INTENDED USE AND AGREE TO VERIFY ALL RESULTS OBTAINED USING MOTOREGISTRY AND THE SERVICES.

IF YOU ARE A CALIFORNIA RESIDENT, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE 1542 IN CONNECTION WITH ANY RELEASE PROVIDED BY YOU IN THESE TERMS OF USE, INCLUDING THE FOREGOING, WHICH SECTION STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR."
